By accessing or using Momo (Modern Monk) ("Service," "App," "we," "our," or "us"), you agree to be bound by these Terms and Conditions ("Terms"). If you disagree with any part of these Terms, you may not access the Service.

These Terms apply to all visitors, users, and others who access or use the Service.

2. Description of Service

Momo is a fitness application that provides:

• Workout Tracking: Log exercises, track weights, monitor progress
• Exercise Library: Official and custom exercises
• Timer Tools: Customizable workout timers (EMOM, AMRAP, Tabata, etc.)
• Analytics: Personal records, statistics, and progress insights

3. Account Registration

3.1 Account Creation

To use certain features of the Service, you must create an account. You agree to:

• Provide accurate, current, and complete information
• Maintain and promptly update your account information
• Maintain the security of your password
• Accept responsibility for all activities under your account
• Notify us immediately of any unauthorized use

3.2 Account Eligibility

You must be at least 13 years old to create an account. By creating an account, you represent that:

• You are at least 13 years of age
• You have the legal capacity to enter into these Terms
• Your use of the Service does not violate any applicable laws

3.3 Account Termination

We reserve the right to suspend or terminate your account if:

• You violate these Terms
• You engage in fraudulent or illegal activities
• We are required to do so by law
• We discontinue the Service

4. User Content

4.1 Your Content

"User Content" includes any data, text, information, or other materials you submit to the Service (workout logs, custom exercises, timer configurations, etc.).

You retain ownership of your User Content. By submitting User Content, you grant us a non-exclusive, worldwide, royalty-free license to:

• Store and backup your content
• Display your content to you
• Process your content to provide the Service

4.2 Content Restrictions

You agree not to submit User Content that:

• Violates any applicable law
• Infringes on intellectual property rights
• Contains harmful or malicious code
• Impersonates another person
• Contains false or misleading information

4.3 Content Removal

We reserve the right to remove any User Content that violates these Terms, without prior notice.

5. Acceptable Use

5.1 Permitted Uses

You may use the Service for:

• Personal fitness and workout tracking
• Using workout timers for exercise routines
• Creating and managing custom exercises
• Accessing your own data and analytics

5.2 Prohibited Uses

You agree NOT to:

• Use the Service for any illegal purpose
• Attempt to gain unauthorized access to the Service
• Interfere with or disrupt the Service
• Reverse engineer, decompile, or disassemble the Service
• Use automated systems to access the Service without permission
• Transmit viruses, malware, or other harmful code
• Collect information about other users without consent
• Use the Service for commercial purposes without authorization
• Share your account credentials with others
• Create multiple accounts to abuse the Service

6. Intellectual Property

The Service uses Clerk for authentication. Your use of authentication is also subject to Clerk's terms and privacy policy.

The Service may contain links to third-party websites or services. We are not responsible for the content or practices of these third parties.

8. Offline Functionality

8.1 Local Data Storage

The Service stores data locally on your device to enable offline functionality. You are responsible for:

• Maintaining adequate device storage
• Backing up your device as needed
• Understanding that local data may be lost if you clear browser data

8.2 Synchronization

When online, the Service will synchronize your local data with our servers. In case of conflicts, the most recent data will typically be preserved.

9. Service Availability

9.1 Availability

We strive to maintain Service availability but do not guarantee uninterrupted access. The Service may be temporarily unavailable due to:

• Scheduled maintenance
• Emergency repairs
• Circumstances beyond our control

9.2 Modifications

We reserve the right to modify, suspend, or discontinue the Service (or any part thereof) at any time, with or without notice.

IMPORTANT: Before beginning any exercise program, consult with your healthcare provider. You use workout features at your own risk.

10.3 Accuracy Disclaimer

We do not guarantee the accuracy of:

• Workout calculations and timers
• Personal record calculations
• Exercise analytics or statistics

11. Limitation of Liability

11.1 Exclusion of Damages

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE SHALL NOT BE LIABLE FOR: Indirect, incidental, special, consequential, or punitive damages; Loss of profits, data, use, or goodwill; Personal injury or property damage; Any damages arising from your use of the Service.

11.2 Cap on Liability

OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR $100, WHICHEVER IS GREATER.

12. Indemnification

You agree to indemnify, defend, and hold harmless Momo and its officers, directors, employees, and agents from any claims, damages, losses, or expenses (including reasonable attorneys' fees) arising from:

• Your use of the Service
• Your violation of these Terms
• Your violation of any third-party rights
• Your User Content

13. Governing Law and Disputes

These Terms shall be governed by and construed in accordance with applicable laws.

13.2 Dispute Resolution

Any disputes arising from these Terms or the Service shall be resolved through:

13.3 Class Action Waiver

You agree to resolve disputes with us on an individual basis and waive any right to participate in a class action lawsuit or class-wide arbitration.

15. Termination

We may terminate or suspend your account immediately, without prior notice, if:

• You breach these Terms
• We are required to do so by law
• We discontinue the Service

Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights.

18. Additional Terms for Specific Features

If you submit exercises or workouts for official review:

• You grant us the right to publish approved content as "official" content
• You represent that the content is original or properly licensed
• Approved content may be used by other users
• You will be credited as the creator (optional)

18.2 Admin and Submitter Roles

Users with special roles (Submitter, Admin, Super Admin) agree to:

• Use elevated privileges responsibly
• Not abuse access to other users' data
• Follow content review guidelines
• Report any security vulnerabilities
